As of December, 2007 SMS Messaging is currently
defined by FINRA as a form of electronic communication and subject to the same rules and supervision
applicable to email and IM. Regulations such as FINRA 17a-4, NASD 3010, Sarbanes-Oxley, HIPAA, and
Gramm-Leach-Bliley now apply to SMS Messaging and failing to comply with these can be a costly mistake
for any financial institution. Due to the phone–to-phone nature of mobile communication, complying with
these regulations is more challenging then with email or IM, which are easily controlled and archived.
